KOTA KINABALU (Nov 26): A security guard of a secondary school here was sentenced to a total of six years’ jail by a Sessions Court here for two charges of asking a student to record herself without any clothes on for sexual purposes and to send the videos to social media WhatsApp.
Judge Amir Shah Amir Hassan imposed the custodial sentence on the 50-year-old man after he pleaded guilty to demand the victim to make her shirtless videos and send to him on WhatsApp.
The two offences were under Section 15(a)(ii) of the Sexual Offences Against Children Act 2017, which provides for a jail term of up to 10 years or a maximum fine of up to RM20,000 or both, upon conviction.
The accused was sentenced to three years’ imprisonment for each of the charges and the judge ordered for the jail terms to run consecutively.
He was further ordered to be put under police supervision for two years upon completing his jail sentences.
The two offences took place on November 19 and November 20 respectively in Papar.
The court heard that a teacher was alerted by a student, who accidentally saw inappropriate messages between the accused and the victim when she borrowed the accused’s phone to call her parents.
A discipline teacher called and interviewed the victim. She revealed that she had sent those videos to a man who was later identified as the accused.
The accused was unrepresented.
